By using or accessing this website and/or placing any order(s), you agree to be legally bound by these terms and conditions. All other terms and conditions, including those that may be proposed in any order submitted by you, are expressly excluded and shall have no effect.

Receipt by Rochester of an order via our website does not constitute legal acceptance of an order. Your order will be deemed to have been accepted by us only once you have received written confirmation of our acceptance. We reserve the right to refuse your order for any reason we see fit.

These terms relate to sales over the Internet only. Separate terms and conditions apply to purchases made directly from our stores.

 
1. VAT

All of our quoted prices are inclusive of VAT at the prevailing rate.

 
2. Payment

Full payment will be required at time of order. Unfortunately Rochester no longer accepts credit cards registered outside of the South Africa. If you wish to cancel an agreement outside the 7 day cancellation period you will not be refunded your moneys paid.

 
3. Delivery

There are various standard delivery charges, ranging from as little as R355 to quoted prices for far outlying areas. where no agreement exists, a minimum of R7 per km will be charged. We only deliver to the first floor of any house/apartment, except when arranged separately at time of order which may incur an additional charge.

Please note delivery may not always be possible in more remote areas of South Africa and/or outside the SouthSfrican border. Should your delivery address be in a remote area or outside the border we request that you please contact us prior to placing your order. Collection can be arranged with orders placed in our stores. Regretfully we are unable to arrange collection for online orders.

Once your product is received at our distribution centre you will be contacted with a scheduled delivery slot. However should this not suite you, two alternatives will be offered. On the delivery day a two person team will man the delivery and place the furniture in the room of your choice (provided there is reasonable access) where they will unwrap and ask you to inspect the product. Please advise us of any irregularities immediately upon inspection as we cannot accept any claim for damage where the product is not unwrapped and inspected at the time of delivery. The delivery team will remove all packaging waste from your premises.

 
4. Split deliveries
On some occasions we may need to make more than one delivery to you. Should this be required you will not be charged for the additional delivery.
 
5. Delivery dates
All delivery dates quoted at the time of your order are estimates. Whilst we make every effort to ensure that we honour estimated delivery dates, it is possible that circumstances beyond our control may cause delivery dates to be changed.
 
6. Title
Ownership of goods shall remain with Rochester and shall not pass to you until the agreed price together with all other sums due from you to Rochester have been paid in full and goods have been delivered to your home, except in cases where goods are purchased on credit and the credit sales agreement specifies otherwise.
 
7. Storage

Unfortunately we do not have the facility to store your product for any length of time therefore if you cannot take the product within two weeks of us advising you of its availability, we will charge storage charges of R95 per day for a maximum of four weeks, after which we deem the order to be cancelled.

Where the product is a standard stocked line, the stock will be returned to free stock, which means that it will be made available to other customers. In this case we cannot guarantee immediate product availability when you are ready to take the order.

This will not apply where a product is available earlier than the lead time indicated or where you have specifically stipulated a 'Not before by date' at the point of order and as printed on your order.

 
8. Disposal of old furniture
We cannot collect or dispose of your old furniture. However we ask that you do not dispose of your old sofa, table or bed if at all possible until delivery has been made as, in the unlikely event of a delivery problem arising, we cannot guarantee a loan piece of furniture.
 
9. Access
Please be aware that it is your responsibility to ensure there is sufficient access to deliver the product into your home and chosen location. You should consider vehicle access, lifts and tight stairs etc. Should windows or doors need to be removed in order for access to be gained it is your responsibility to arrange this at your own cost and risk. If you are unsure about access to or within your property, please visit your nearest store and discuss this with a salesperson to avoid disappointment.
 
10. Colours and finishes
Photographs displayed on our website and display models and samples in our stores are representative of the finished product. Whilst every effort will be made to match all colours and finishes, goods are supplied with the understanding that there may be slight dye, shade and grain variations, particularly with natural products such as wood and leather. Leather products are made from quality hides and may not be uniform in colour or texture and will show natural marks and scars. Where stated, some images have been digitally created to illustrate the colour options available for this range. These colours will be affected by your monitor and by your printer and therefore may not be 100% accurate to the finished product. Exact colour swatches can be seen in store.
 
11. Size and description of product
All sizes quoted are approximate. Size and product descriptions are given in good faith from our suppliers' information. Products are manufactured to perform within the appropriate industry measurement tolerances.
 
12. Variation in product specification
Due to the shortage of certain new raw materials, changes in legislation or safety requirements some products supplied by the Company may have minor technical alterations and could differ slightly in actual construction from the goods shown in sample or pattern form. The Company state any changes that are made will result in a performance of an equally high or improved standard. The quality coding will remain the same and the quality guarantee will continue to apply.
 
13. Guarantee
All goods supplied are guaranteed by the manufacturer for a period of 12 months from date of delivery in respect of faulty workmanship or materials. Your statutory rights are unaffected.

15. General care
The product(s) supplied are to be used for the purpose and in the manner for which they were designed. Most manufacturers include care and maintenance advice with their products, which should be read and followed. No responsibility will be accepted for damaged caused by cleaning if the care and maintenance instructions have not been followed.
 
16. Amending or cancelling your order WITHIN 7 days of placing your order (online only)
We promise to give you a full refund if you change your mind for any reason within 7 days of placing your order with us. After this date we will have in most cases a binding contract with our suppliers to supply or make your product. Any damaged goods must be reported within 7 days of the order being accepted and should be reported as such at the time of delivery for the query to be valid.
 
17. Cancelling your order AFTER 7 days of placing your order

Made to Order Products
Made to order products, have been produced specifically for you, therefore no refunds or exchanges can be made after 7 days of placing your order unless there is an error on our part regarding the product specification, or the item is found to be faulty.

For products ordered over the Internet, you have the right to cancel orders on products that are not made to order by notifying us in writing (including email) before delivery or within 7 working days of receiving of the goods.

Exceptions to this policy
The Cancellation and Refund policy described above will stand unless:
We have not followed your instructions clearly
The order has been delayed by more than 5 weeks after the lead time quoted to you in writing at the point of order
The product is found to be faulty
All refunds in excess of R1 will be made via our Head Office.

 
18. Cancellations by Rochester

We reserve the right not to accept an order if:

  • We do not have the stock to fulfil the order
  • If we are unable to deliver the product to your area
  • If an item was incorrectly priced or described on the web site
  • If your payment was not authorised
  • If you have not complied with our terms and conditions of sale
  • If an order is cancelled by Rochester, any payments made to us will be refunded within 2 days of the cancellation.
